Please read these terms carefully before using EverResume. By using our service, you agree to these conditions.

1. Acceptance of Terms
By accessing or using the EverResume platform, website, and any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and EverResume ("we," "us," or "our"). We reserve the right to update, modify, or replace any part of these Terms at our sole discretion. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 16 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirements and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access to or use of your account.
We reserve the right to suspend, disable, or terminate your account at any time, for any reason, including but not limited to a violation of these Terms, extended inactivity, or at our sole discretion. Upon termination, your right to use the Service ceases immediately.
4. User Content & License Grant
You retain ownership of the data and content you submit to the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, process, aggregate, display, and distribute your User Content solely for the purposes of operating, developing, improving, and providing the Service.
You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and to grant the license described above. You are solely responsible for the accuracy, quality, integrity, and legality of your User Content.
We may use aggregated, anonymized, or de-identified data derived from your use of the Service for analytics, research, product improvement, and business purposes without restriction.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload, transmit, or distribute malicious code, viruses, or harmful content.
- Attempt to gain unauthorized access to the Service, other accounts, or related systems.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Use the Service to infringe upon the intellectual property or privacy rights of others.
- Interfere with or disrupt the integrity, performance, or availability of the Service.
- Use automated means (bots, scrapers) to access the Service without our written consent.
We reserve the right to investigate and take appropriate action, including removal of content and account termination, against anyone who violates this provision at our sole discretion.
6. Service Modifications & Availability
We reserve the right to modify, suspend, or discontinue the Service (or any part or feature thereof) at any time, with or without notice. This includes the right to add or remove features, impose usage limits, or change pricing for premium tiers.
We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service. Your use of the Service is at your sole risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EVERRESUME, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months prior to the event giving rise to the liability, or (b) one hundred dollars ($100 USD).
9. Indemnification
You agree to indemnify, defend, and hold harmless EverResume and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) your User Content.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.
You agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred. You waive any right to a jury trial in any proceeding arising out of or related to these Terms.
11. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EverResume regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign yours without our prior written consent.
- Force Majeure: We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control.
